Terms of Service

These Terms of Service ("Terms") govern your access to and use of Binder Builder ("the Service"), operated by Amaya Media ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Description of Service

Binder Builder is a web application that allows users to browse, track, and manage their Pokemon Trading Card Game collections. The Service provides card browsing, variant-level tracking, collection statistics, and optional premium features through a paid subscription.

2. Accounts

The core features of Binder Builder are available without an account. Collection data is stored locally in your browser using localStorage. You may optionally create an account to access premium features such as cloud synchronization.

When you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to provide accurate and current information during registration and to update such information to keep it accurate.

3. Subscriptions and Payments

Binder Builder offers a "Pro" subscription plan with additional features. Subscriptions are billed on a monthly or annual basis at the prices displayed on the Pro page at the time of purchase.

All payments are processed by Polar.sh, which acts as our Merchant of Record. Polar.sh handles all payment processing, invoicing, and tax compliance (including VAT, GST, and sales tax) on our behalf. By making a purchase, you also agree to Polar.sh's terms of service.

Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date. You may cancel your subscription at any time through the customer portal accessible from your account page. Upon cancellation, you retain access to Pro features until the end of your current billing period.

Refund requests are handled in accordance with Polar.sh's refund policy. As Merchant of Record, Polar.sh manages all refund processing.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to gain unauthorized access to the Service, other user accounts, or any related systems or networks.
• Interfere with or disrupt the integrity or performance of the Service.
• Use automated means (bots, scrapers, etc.) to access the Service without our prior written consent.
• Resell, redistribute, or sublicense any part of the Service.

5. Intellectual Property

Pokemon, Pokemon Trading Card Game, and all related names, characters, images, and trademarks are the property of Nintendo, Creatures Inc., GAME FREAK Inc., and The Pokemon Company. Binder Builder is an independent fan project and is not affiliated with, endorsed by, or sponsored by any of these entities.

Card images displayed in the Service are sourced from publicly available APIs and are the property of their respective copyright holders. The Service's original code, design, and content (excluding Pokemon-related intellectual property) are owned by Amaya Media.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure. We are not responsible for the accuracy of card data sourced from third-party providers.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Amaya Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your access to or use of the Service.

In no event shall our aggregate liability exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without prior notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

You may delete your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease. Any data stored in the cloud will be deleted in accordance with our Privacy Policy.

10. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes by updating the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.
